Welcome to But Why? — the home of premium embroidered trucker hats for people (and penguins) who choose the mountain over safety.

These Terms of Service (“Terms”) govern your access to and use of the website butwhybrand.com (the “Site”), all products offered through the Site, and any related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase from us.

2. Products & Orders

  • All products are subject to availability. We reserve the right to discontinue any product at any time.
  • We do our best to display colors and details accurately, but actual appearance may vary slightly due to monitor settings or production differences.
  • We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, or product unavailability. If we cancel an order after payment, we will issue a refund to your original payment method.

3. Pricing & Payment

  • All prices are listed in U.S. dollars and exclude applicable sales tax unless otherwise stated.
  • Sales tax will be added where required by law based on your shipping address.
  • Payment is due at the time of purchase. We accept the payment methods displayed at checkout.
  • By providing payment information, you represent that you are authorized to use the payment method.

4. Shipping & Delivery

  • Shipping times are estimates only and are not guaranteed.
  • Risk of loss and title for products pass to you upon delivery to the carrier.
  • We are not responsible for delays caused by the carrier, customs (for international orders), or events beyond our control.

5. Returns & Refunds Our Return & Refund Policy (available on the Site) forms part of these Terms. Please review it for details about returns, exchanges, and refunds.

6. Intellectual Property The Site, its design, text, graphics, logos, product images, and all other content are the property of But Why? or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent, except as permitted by law (e.g., fair use).

7. User Content If you submit reviews, photos, comments, or other content (“User Content”) to the Site or our social media channels:

  • You grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, and distribute that content in connection with the Site and our marketing.
  • You represent that your User Content does not infringe any third-party rights and does not contain unlawful or offensive material.

11. Governing Law & Dispute Resolution These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Dallas County, Texas. You consent to the personal jurisdiction of those courts.

12. Changes to These Terms We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Site after changes constitutes acceptance of the new Terms.
